Harrisburg car accident lawyer Christopher Marzzacco recently settled a $1.85 million wrongful death claim on behalf of the estate and the parents of a 20-year-old man fatally injured in a truck collision.

The driver of a Tiger Trash commercial refuse truck recently completed a container drop and failed to lower the boom of the truck. The truck was attempting to drive under an overpass when the elevated boom struck the overpass.  Upon impact, the truck rolled over on its side and landed on top of the vehicle driven by 20-year old Philip Ayler.

Ayler was pinned under his vehicle and suffered traumatic brain injuries.  He was extricated from the vehicle and pronounced dead at Harrisburg Hospital.

“Philip had been working diligently at two full-time jobs and had aspirations of becoming a CDL-certified truck driver,” said Marzzacco. He called Philip a “wonderful young man with a promising future.”

Marzzacco vigorously negotiated a $1.85 million settlement with multiple insurance companies on behalf of Ayler’s parents. He settled a wrongful death claim with the truck driver’s insurance company and the insurance company for Tiger Trash. He also filed an underinsured motorist claim under Ayler’s coverage.

“I hope the settlement sends a message to the responsible parties and provides this wonderful family with some piece of mind in this tragic situation,” said Marzzacco.

Dauphin County President Judge Richard A. Lewis formally approved the wrongful death settlement on April 16, 2015
